VA Aid and Attendance Basics  

VA Aid and Attendance is a tax-free benefit that can help pay for assisted living or in-home care. To qualify, a veteran must have served at least one day during a 90-day wartime period and have medical needs that create unreimbursed expenses, such as caregiver support, assisted living fees, or copays. Surviving spouses can sometimes qualify based on the veteran’s service and their own medical needs.  

How VA Rules Differ From Medicaid  

Both VA Aid and Attendance and Medicaid look at income, assets, and medical expenses, but they use different rules. The VA counts household assets, including retirement accounts, and applies a net worth cap. Medicaid treats many retirement accounts differently and focuses more directly on nursing home costs. Planning should consider both systems together so families are not helped in one area and hurt in another.  

Smart Strategies to Protect Assets  

Common strategies include carefully tracking unreimbursed medical expenses, paying down debt such as mortgages or car loans, and prepaying funeral costs. Attorneys may recommend a mix of revocable and irrevocable trusts to keep total assets under VA limits while still preserving savings for a spouse or heirs. Timing and documentation are critical to avoid VA or Medicaid penalties.

Families often wait too long to ask questions or assume a simple revocable trust provides full protection. A better approach is to review benefits and estate planning together early, ideally before a crisis, and to coordinate with accredited veteran service organizations that assist with VA applications.
